EU Asylum for African Homosexuals

In most African countries, homosexual behavior is illegal.


The EU Court ruled that homosexuals from African countries could receive asylum in the EU.

This decision was taken after the Dutch Supreme Court asked the question whether three homosexual men from Sierra Leone, Uganda, and Senegal can be considered as part of a persecuted people.
Court in Luxembourg said yes even if each insists on EU governments to decide whether homosexuality is indeed facing punishment in the country.
Decision states that homosexuals in some countries do not dare to express sexual orientation in their country to avoid punishment.

Homosexual behavior considered illegal in most African countries, though not all apply the law strictly.
Last September, Uganda had arrested a British drama producer, David Cecil, on charges related drama about homosexuality.
Indictment But lately it revoked.
With the decision in this Luksemberg, the Dutch Supreme Court will continue the asylum question.
However there are still questions about how to ensure the background so that the person's sexual inclination is classified as homosexual.
Dutch Supreme Court also asked the question but reported on will take a decision in the case next year.
